Structure of CPC

The CPC has two parts: The Sections (substantive law) and The Orders (First Schedule - rules of procedure). For example, Section 26 says a suit shall be instituted, but Order 7 tells you how to write the plaint.

Filing & Pleadings Orders 6, 7 & 8
  • Order 6
    Pleadings Generally: Rules regarding drafting of Plaint and Written Statement. Must state facts, not law.
  • Order 7 Rule 11
    Rejection of Plaint: The court can reject a case immediately if it discloses no cause of action or is barred by law. Critical Defense Tool

    Written Statement: The defendant's reply to the lawsuit. Must be filed within 30 days.

Jurisdiction & Powers Sections 9 - 151
  • Section 9
    Courts to try all civil suits: Civil courts have jurisdiction over all suits of a civil nature unless expressly barred.
  • Section 11
    Res Judicata: No court shall try a suit or issue that has already been decided between the same parties. (You cannot sue twice for the same thing).
  • Section 151
    Inherent Powers: The court has inherent power to make any order necessary for the ends of justice or to prevent abuse of the process of the court.
