Token Money (Bayana)

AGREEMENT TO SELL

This Agreement is made at [City] on this [Day] day of [Month, Year].

BETWEEN
[Name of Seller], S/o [Father's Name], CNIC No. [00000-0000000-0], Resident of [Address] (hereinafter called the VENDOR).

AND
[Name of Buyer], S/o [Father's Name], CNIC No. [00000-0000000-0], Resident of [Address] (hereinafter called the VENDEE).

WHEREAS the Vendor is the absolute owner of the property measuring [Area, e.g., 10 Marla] bearing Plot/House No. [Number], situated at [Society/Location Name], (hereinafter called the "Property").

NOW THIS AGREEMENT WITNESSETH AS UNDER:

  1. That the total sale consideration of the property has been fixed at Rs. [Total Amount] (Rupees [Amount in Words]).
  2. That the Vendee has paid Rs. [Bayana Amount] as earnest money (Bayana) to the Vendor in cash/cheque No. [Number] today.
  3. That the remaining balance of Rs. [Remaining Amount] shall be paid by the Vendee on or before [Date of Final Payment].
  4. That upon full payment, the Vendor shall execute the Sale Deed/Transfer Letter in favor of the Vendee and hand over vacant possession.
  5. That if the Vendee fails to pay the balance by the due date, the Vendor shall have the right to forfeit the earnest money.
  6. That if the Vendor refuses to sell, they shall be liable to pay double the earnest money to the Vendee.
