1. Power of Attorney (Mukhtar Nama)
This is crucial for Overseas Pakistanis who cannot visit Pakistan to handle their affairs. It authorizes another person to act on your behalf.
Used for broad powers, including managing, selling, or renting out multiple properties.
Key Clauses: Power to sell, power to receive money, power to represent in court.
Used for a specific task only (e.g., selling one specific car or appearing in one specific court case). The power ends once the task is complete.
For Overseas Execution: The document must be signed in front of the Pakistani Embassy/Consulate staff abroad, attested by the Foreign Office (MOFA) in Pakistan, and then registered with the local Registrar.
2. Sale Agreement (Iqrarnama Bayana)
This is the initial contract between a buyer and seller before the final registry.
Essential Clauses:
- Total Consideration: clearly stating the total price.
- Bayana (Token): Amount paid in advance.
- Schedule of Payment: When the remaining balance will be paid.
- Possession Date: When the keys/possession will be handed over.
- Default Clause: Penalty if the buyer fails to pay or the seller refuses to sell (usually double the token money).
3. Lease / Rent Agreement
To protect both Landlord and Tenant, this agreement should be registered with the Rent Registrar (for Punjab) or Police Station.
Essential Clauses:
- Term of Tenancy: Start and end date (usually 11 months).
- Security Deposit: Amount held as security (refundable).
- Annual Increase: Usually 10% increase after one year.
- Termination Notice: Typically 1 or 2 months' notice required to vacate.
- Maintenance: Who is responsible for minor vs. major repairs.
4. Legal Notice
A formal warning letter sent before filing a court case.
Structure:
- Parties: Addressed clearly to the defaulter.
- Grievance: Clearly stating facts (e.g., "You have failed to pay rent for 3 months").
- Demand: Specific action required (e.g., "Pay Rs. 50,000 within 14 days").
- Consequence: Threat of legal action (civil/criminal) if the demand is not met.
